San Francisco (670 KBOI News) – As President Trump gets closer and closer to getting the funding for the border wall, a decision by the 9th US Circuit Court of Appeals has apparently taken key legal obstacles out of his way.
Earlier this week, a three-judge panel of the 9th Circuit ruled Trump and the Department of Homeland Security have the authority to build the border wall, says Constitutional attorney Christ Troupis of Eagle.
“That the Secretary (of Homeland Security) has the absolute authority to build the border wall, that he or she has the authority to waive all the other laws,” said Troupis. “There are 37 laws federal laws waived, including the environmental restrictions, the EPA stuff, all the zoning restrictions, everything.”
Troupis says the waivers can’t even be appealed anywhere short of the US Supreme Court.
The suit was brought by the State of California, the Centers for Biological Diversity, the Defenders of Wildlife and other environmental groups against the Department of Homeland Security.
It was a 2-1 decision; the two judges who voted in favor of the DHS were both appointed by Democratic presidents.
